| Message Board Terms of Service Last Updated: June 28, 2006 The Service, Web site, and the community tools featured herein are brought to you by Atari, Inc. In addition to the general Terms of Service applicable to your use of any Atari, Inc. site (the "Atari, Inc. Terms of Service"), the following additional Terms of Service (the "Additional Terms of Service") will apply to your use of the Service. Your continued use of the Service constitutes your binding acceptance of these Additional Terms of Service and of the Atari, Inc. Terms of Service as well as your acceptance of Atari, Inc.’s Privacy Policy. We are trying to provide the highest quality Community experience for all of our members and following these guidelines is the best way to maintain a quality environment for all age groups. These rules are very basic and we hope that you read them fully. Often a particular forum will have a thread marked as "Attention" any additional rules will be listed there; you will be expected to abide by those as well. | Due to the large quantity of forum users we have implemented a warning system that tracks any rule violations that you incur. Please note that we do not allow for appeals on warnings. We have brief definitions of the warnings listed below. A full point system can be found here. (Note: Not all warnings are applicable in all forums
and that Atari reserves the right to change any part of the warning system at
any time without prior notice.)
1. General Poor Behavior Any type of poor behavior not covered by any of the other warnings. 2. Off Topic: We suggest all Off Topic threads go in the Community Chat Forum. A select few title forums allow off topic threads, but a good rule of thumb is that you need to post off topic threads in Community Chat. 3. Double Posting: This is known as sequential replies, or posting two replies in a row. Please allow other users to reply before post again. If you forgot something in your original post, please use the edit function to avoid adding to the database. 4. Quoting Images: Do not quote images, please edit the [img] tag out so only a link will appear instead of the image in the quoted text (smilies exempt). 5. Swearing: Only forums which game have an M rating allow swearing. If you are found swearing outside of those forums you will be warned. 6. Avatar / Signature Abuse: Please note that we do not allow sexual avatars, images in signatures, racist remarks or advertising (see below, Rule 10). Signature text & effects should be no more than 5 lines of standard font text (or the equivalent) on a 1024x768 resolution. 7. Insubordination: Please note that the above rules cannot cover every topic that might present itself. If a forum official informs you to stop doing something we ask that you comply. This also covers ignoring additional rules outlined in an Attention thread stuck to the top of the forum. 8. Spamming: Please note that a definition of spamming is hard to pin down and we leave this up to forum officials on a case by case basis. For general purposes it is any post that does not add any worth to the forum. It could also be obnoxious posts, smilies only, replies that have little intellectual worth, or even large quantities of Off Topic replies. 9. Trolling: Any series of posts from a user who is set on causing conflict or provoking other users. Again this is monitored on a case by case basis. 10. Advertising: Advertising any product or service that is for profit or detracts from general forum social life. 11. Private Messaging Abuse: Threatening, Spamming, otherwise offensive use of our PM service. 12. Flaming: Excessive aggression to other forum users. (Forum Dependant) 13. Racist/Sexist Remarks: Offensive comments towards another race or sex. A lesser offensive post might also receive this voilation. 14. Offensive Material: Any sexually oriented imagery or links to such content will not be tolerated. 15. Illegal Software References: Links, discussion, or related information to Warez or illegal software of any type. 16. Misc. Instant Ban By Admin. This is listed for our staff as a form of Instant Banning for any content that would deem immediate action but does not have a specific topic. This is at an admins discretion, and can be for any reason above and beyond those outlined above. |

15. Minors If you have agreed to allow your minor child, or a child for whom you are legal guardian (a "Minor"), to use the Service, you agree that you will be solely responsible for: (a) the online conduct of such Minor; (b) monitoring such Minor's access to and use of the Service; (c) the consequences of any use of the Service by such Minor. Children under the age of 13 cannot enter restricted areas of the Service. At various places on the Service, we ask users to enter their age. Atari relies on our users to be truthful in responding to these questions. If a user does not identify his/her proper age, we will have no way of verifying actual age with respect to our privacy policy. 16. Child Online Protection Act Notification Pursuant to 47 U.S.C. Section 230(d) as amended, Atari hereby notifies you that parental control protections (such as computer hardware, software, or filtering services) are commercially available and may assist you in limiting access to material that is harmful to minors. Infringement Policy Atari, pursuant to 17 U.S.C Section 512 as amended by Title 11 of the Digital Millennium Copyright Act (the "Act"), reserves the right, but not the obligation, to terminate your license to use the Service if it determines in its sole and absolute discretion that you are involved in infringing activity, including alleged acts of first-time or repeat infringement, regardless of whether the material or activity is ultimately determined to be infringing. Atari accommodates and does not interfere with standard technical measures used by copyright owners to protect their materials. In addition, pursuant to 17 U.S.C. Section 512(c), Atari has implemented procedures for receiving written notification of claimed infringements and for processing such claims in accordance with the Act. All claims of infringement must be submitted to Atari in written complaint that complies with the requirements below and is delivered to our designated agent to receive notification of claimed infringement. Modification Atari reserves the right in its sole discretion, to amend this Agreement, and to modify, add or discontinue any aspect, or feature of the Service. Such amendments, modifications, additions or deletions will become effective upon notice of that action, which may be provided to you by posting on the Service, via e-mail or any other reasonable means. Continued use of the Service by you will constitute your binding acceptance of any such amendments, modifications, additions or deletions. 19. Export Control Information Unless otherwise specified, the materials on the Service are presented solely to provide information regarding and to promote the Atari Service and other products available in the United States, its territories, possessions and protectorates. The Service is controlled and operated by Atari from its offices within the state of New York, United States of America. Atari makes no representation that materials on the Service are appropriate or available for use outside the United States. Those who choose to access the Service from outside the United States do so on their own initiative and are responsible for compliance with local laws, if and to the extent that the local laws are applicable. Software from the Service is further subject to United States export controls. Miscellaneous This Agreement will be governed by and construed in accordance with the laws of the State of New York without giving effect to any principles of conflict of law. Although you acknowledge that we will have the ability to enforce our rights in any court of competent jurisdiction, you hereby consent to the exclusive jurisdiction and venue of courts in New York, New York, U.S.A., regarding any and all disputes relating to this Agreement or your use of the Service. You acknowledge and agree that the warranty disclaimers and liability and remedy limitations in this Agreement are material terms of this Agreement and that they have been taken into account in the decision by Infogrames to provide the Service. You may not assign any of your rights, obligations or privileges without the prior, written consent of Atari. Any assignment of the foregoing other than as provided for in this section under this Agreement will be null and void. If any provision of this Agreement will be unlawful, void, or for any reason unenforceable then that provision will be deemed severable from this Agreement, will be enforced to the fullest extent allowed by law as to affect the intention of the parties, and will not affect the validity and enforceability of any remaining provisions. This Agreement and any posted operating rules constitute the entire Agreement of the parties with respect to the subject matter of this Agreement, and supersede all prior or contemporaneous communications and proposals whether oral, or written, between the parties with respect to the subject matter of this Agreement, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between the parties with respect to such subject matter. No waiver of any provision or any right granted under this Agreement will be effective unless set forth in a written instrument signed by the waiving party. No waiver by either party or any breach or default under this Agreement will be deemed a waiver of any subsequent breach or default. You agree not to reproduce, duplicate, copy, or sell, resell, or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service. The titles and subtitles used in this Agreement are used for convenience only and are not to be considered in construing or interpreting this Agreement. |
